    Interesting article out of Japan. Looks like Ampligen may in fact be effective as an adjuvant. Should be looked at as good news.

    Carter misled people and lied people about HEB, he belongs in jail. The article put out today is by Adam Feuerstein of the street. I'm not a fan of Feuerstein as he seems like quiet the doushbag after what he had to say about DNDN and HGSI months ago before they blew up but he's dead on about HEB and Carter. Though if you had read the SEC filings and listen to Carter it was easy to see that things weren't all on the up and up.

    PHILADELPHIA, Pa. (TheStreet) --Hemispherx Biopharma(HEB Quote) issued an "update" to the regulatory status of its chronic fatigue syndrome drug Ampligen in which the company essentially admits that its prior public statements were false and misleading.

    Monday's statement was likely crafted by Hemispherx's lawyers as a way to help CEO Bill Carter wiggle out of public statements he made in May and June claiming the Ampligen application to the U.S. Food and Drug Administration to be complete. Carter insisted regulators weren't asking for any additional information on Ampligen. Carter's made these statements both before and immediately after the FDA approval decision date for Ampligen on May 25, which came and went without any word from the agency. We now know that Carter's statements were demonstrably false. The FDA application for Ampligen was not complete because several items were outstanding, the company now states. These included FDA requests for data on Ampligen's safety both in humans and animals. The FDA also required additional information about Ampligen's manufacturing.
    In its Monday update, Hemispherx said it is still compiling all the data requested by FDA and will not be done until December.

    I really don't understand how FDA and SEC work. Do the information provided by HEB thru Bio Med Reports consistent with yesterday's news

    I really don't care about AF's articles since there are so many negative comments from many readers. I'm concerning information in Bio Med Reports since I use that site info. Bio Med Reports is quite silence about HEB now. How can anyone trust Bio Med Reports after this HEB's case?

    Both Ampligen and Alferon are also being evaluated in various early, middle and late stage trials to measure their effectiveness in treating various chronic diseases and viral disorders.

    The data publish on Ampligen is very old data and HEB is seeking approval on old data.

    "Dyer & Berens LLP announced that it has filed a class action lawsuit in the United States District Court for the Eastern District of Pennsylvania, Civil Action No. 09-cv-5262, on behalf of all purchasers of the securities of Hemispherx Biopharma, Inc. between February 18, 2009 and October 30, 2009, for violations of the federal Securities Exchange Act of 1934. The complaint alleges that, during the Class Period, defendants misled investors regarding the status of Hemispherx's New Drug Application (NDA) for Ampligen with the U.S. Food and Drug Administration (FDA). Specifically, defendants failed to disclose and misrepresented the fact that the FDA had requested several reports from the Company before the NDA could even be considered, thus delaying the possible approval of Ampligen by several months at a minimum. On November 2, 2009, when the Company belatedly disclosed this information, the per share price of Hemispherx's common stock dropped from $1.45 on the previous day to $1.13, a drop of more than 20%. The next day, one commenter characterized the November 2 Company update as essentially an admission that its prior public statements were false and misleading"



    WHAT DOES THIS MEAN FOR US? I am actually one of those poor souls that lost about $6000 due to this stock when it plummeted from $4.57.     Sold it today @ 1.12 w/ 50% loss... These are my reasons:
    1. Primitive technical analysis:
    1. 1y graph shows double top.
    2. The EMA is declining.
    2. Dyer & Berens lawsuit. Although I don't think that lawsuit itself will make any damage but the fact that they(HEB) didn't make any official announcement disturbs me....

    So far Im down 70%, this is just downright ridiculous. I wonder if I should just stay in at this point, and hope for the best with the lawsuit money down the road.

    I think that stock holders will get the money even if they will sell the stocks before the decision on the lawsuit (assuming of course that the lawsuit will be won)....

    What money? It's not like HEB is sitting on a huge pile of cash. If won, maybe some people will see pennies on the dollars that they lost.

    Can't argue with that :-). While reading post from dakotus I got an impression that he is not willing to sell his shares because he is waiting for the money from the lawsuit. This is the reason why I wrote that in case of successful lawsuit also shareholders that already sold their shares will get the money.

    I'm fully agree with you that the probability of getting some real money from the lawsuit is very small (IMO).
